Group Insurance Fair Representation Statement
It is an insurance regulatory requirement that all IRVAP insurance members read and comply with a “Fair Representation & Eligibility Declaration Statement” detailed below.

Insurance Certification Generation
Your cover will become active once you have had your application fully processed. It may take several weeks for you to receive your insurance certificate from us due to the validation checks we are required to undertake. You will be emailed your individual insurance certificate in a PDF format.
Cooling Off Period
There is no cooling off period for the purchase of this policy. Should your application for membership be declined, your insurance premium will be refunded to you. No refunds of premium will be allowed if you decide to withdraw from your membership of IRVAP at any point after the cover has been arranged.
Data Processing
In order to fulfil our obligations to our insurers we will share personal data with the above named insurers inline with our obligations under the General Data Protection Regulations (GDPR).
Fair Representation
It is important that you tell us everything about you in good faith and what you want to insure, including any specific
concerns that led you to seek cover. To do this you need to answer all questions we ask you accurately and to the
best of your knowledge and ability by making specific enquiries of partners, directors and senior management
involved in the business and its subsidiaries. You must tell us of anything that may be relevant or important for
insurers to know so that they can make decisions on whether to offer cover, the type of cover to offer the terms to
be applied and the required premium. If you don’t do this and a relevant piece of information is missed then you
may not be covered correctly, your insurance may be invalid, or you may be charged a higher premium. If you are in
any doubt/not sure then just tell us. For example, you should inform us of any different, special or any unusual
aspects of your business activities in comparison to what would be considered ‘typical’ in the market place for your
trade, business or profession.
In addition to the information below, you have confirmed the following:
- You and any Employees carrying out each of the activities or therapies listed is appropriately qualified (or
on an approved training course leading to a recognised qualification)
Eligibility Statement
- You are a Partner or Director of a firm for which cover is required
- You have not had insurance cancelled or special terms imposed on your insurances.
- You have not had insurance refused or declined
- Within the last 5 years you have not made any claims (including legal expenses) or suffered any losses
relating to this type of insurance
- Other than claims already notified to us you are not aware of any circumstances which may give rise to a
claim against you
- You have not been convicted or charged with (but not yet tried) or given an official police caution in respect
of any offence other than a motoring offence.
- You have not been made bankrupt, insolvent or liquidated.
- You have not been served with any county court judgements or other similar judgements in relation to debt.
- You have not been disqualified from being a Company Director.
- You have not, within the last 5 years, been prosecuted or served prohibition or improvement order under
Health and Safety legislation
- You do not work outside of the UK
Declaration
This insurance has been agreed on the basis that a fair presentation of the risk has been made and the following facts are accurate to the best of Your knowledge and belief. If You are proposing for cover on behalf of a business, which is a company or partnership, then the declarations extend also to any director or partner of that business. If the information in the attached Schedule is incorrect or incomplete, or if the insurance does not meet Your requirements, please tell us as soon as possible.
Notice to Policy Holders
The following updates have been made to your Legal Cover Insurance under Section B Legal Expenses Insurance. Please refer to your policy wording for further details.
- The insurer has removed cover for Employment Disputes under sub-section 4 and Employment Compensation Awards under sub-section 5. Therefore, these covers are no longer available under your policy.
- The insurer has removed cover for Contracts Disputes under sub-section 11. Therefore, this cover is no longer available under your policy.
- The inclusion of Liquidation Condition in “Special or unusual conditions and terms” and at the end of “Important Information” after the Brexit Condition.
- The insurer has clarified choice of representative where the insurer is liable to pay an award of compensation.
- The contact information for the Markel Complaints Department has been updated.
- The Brexit condition has been updated, to remove reference to the United Kingdom or Great Britain and Northern Ireland.
- Exclusion 2 under “Tax Protection” will now only apply for tax returns over 90 days late.
- Exclusion 1 under “Property Disputes” will now not apply to title documents.
- The insurer has increased all excesses to £1,500
- The insurer has reduced the limit for Fitness to practice from £250,000 to £20,000.
- The insurer has removed £250,000 limit for Pre-hearing representation and replaced it with Interim Order hearings £2,500 and Pre-hearing response £5,000.
- The “Coroner’s Inquest Representation” cover has been extended to include “where failure to take part in the inquest could result a Fitness to Practise investigation against you by the Regulator or a criminal prosecution”.
- Section 1: “Fitness to Practise Defence” has been updated to include response to formal allegations made by your regulator against you concerning your Fitness to Practise.

Handling Claims
If you wish to make a claim, you should contact us as soon as possible. You should not settle, reject, negotiate or agree to pay any claim without the Insurer's written permission. Please see the policy wording for claims contact details.
